    General terms and conditions Contracting parties On the basis of these General Terms and Conditions (GTC), a contract is concluded between the customer and SICA up cycling design, represented by Simone Simonato Proskauer Str. 4, 10247 Berlin, mail: info@sica-up.com, sales tax identification number: DE294513299, hereinafter referred to as the offeror. The contract will be drawn up in German. The further implementation of the  Contractual relationship is in German. The law of the Federal Republic of Germany shall apply exclusively. This only applies to consumers insofar as no legal provisions of the state in which the customer is domiciled or habitually resident are restricted as a result. The place of jurisdiction for disputes with customers who are not consumers, legal entities under public law or special funds under public law is the registered office of the offeror. Subject matter of the contract This contract regulates the sale of new goods in the field of clothing, living accessories, bags and accessories via the offeror’s online shop on the website https://www.sica-up.com/. Any conflicting general terms and conditions of the customer are objected to. For details of the respective offer, please refer to the product description on the offer page. Conclusion of contract The contract is concluded exclusively in electronic business transactions via the shop system. The presented offers represent a non-binding invitation to submit an offer by the customer order which the offeror can then accept. The ordering process for concluding a contract comprises the following steps in the shop system: The customer selects the desired product by clicking the button “Add to cart” and that way adds the product to the order. Once an item was added by clicking the symbol “Shopping bag” the customer can have a look at the selected goods. By clicking on “Proceed to checkout” he can complete the order. Finally the order can be transmitted to the provider via the “Buy” button after filling the form. Until the dispatch of his order, the customer has the possibility at any time to view and change the data given in the context of the order or to cancel the order completely. The customer receives a confirmation e-mail that the order has been received by the offeror. Reservations The offeror reserves the right to provide a service of equal quality and price. The service shown in the shop is exemplary and not the individual, contractual service. The offeror reserves the right not to provide the promised goods and services in case of unavailability. Prices, shipping costs, return costs All prices are final prices and include VAT. In addition to the final prices, depending on the type of dispatch, further costs will be incurred which will be displayed before the order is dispatched. If a right of revocation exists and is made use of this, the customer bears the costs of the return. Shipping costs are borne by the customer. The goods will be shipped to the delivery address specified by the customer when placing the order. The dispatch takes place via a dispatch enterprise selected by the offeror. The shipping costs can be found in the corresponding product description. If the delivery is made to non-EU countries, additional customs duties, taxes or fees may have to be paid by the customer but not to the offeror but to the competent customs or tax authorities there. The customer is recommended to ask the customs or tax authorities for the details before ordering.  

    Cancellation Policy

    Terms of Delivery   The goods will be dispatched immediately after receipt of confirmed payment. The dispatch takes place on the average at the latest after 7 working days. The entrepreneur undertakes to deliver on the 10th day after receipt of the order. The standard delivery time is 7 working days, unless otherwise stated in the item description. The offeror ships the order from his own warehouse as soon as the entire order is in stock there. The customer will be informed immediately of any delays. If the offeror is not responsible for a permanent obstacle to delivery, in particular force majeure or non-delivery by his own suppliers, although a corresponding covering transaction was concluded in good time, the offeror has the right to withdraw from a contract with the customer in this respect. The customer will be informed immediately and any services received, in particular payments, will be refunded.   Right of revocation and customer service, instruction on revocation and right of revocation You have the right to revoke this contract within fourteen days without giving reasons. 

The revocation period is fourteen days from the day of revocation, • In the case of a contract of sale: on which you or a third party appointed by you, who is not the carrier, took or has taken possession of the last goods. • In the case of a contract for several goods ordered by the consumer under a single order and delivered separately: on which you or a third party appointed by you, who is not the carrier, took or has taken possession of the last goods. • In the case of a contract for the delivery of goods in several partial consignments or pieces: on which you or a third party appointed by you, who is not the carrier, took or has taken possession of the last partial consignment or the last piece. • In the case of a contract for the regular delivery of goods over a specified period of time: on which you or a third party appointed by you, who is not a carrier, took or has taken possession of the first goods. When several alternatives come together, the last point in time is decisive.

To exercise your right of withdrawal, you must inform us (SICA info@sica-up.com) by means of a clear declaration (e.g. a letter sent by post, fax or e-mail sent by) of your decision to withdraw from this contract. You can use the attached cancellation form, but this is not mandatory.

 In order to comply with the revocation period, it is sufficient that you send the notice of the exercise of the revocation right before the expiry of the revocation period.

   Consequences of the revocation   If you revoke this contract, we will refund only payments we have received from you related from product purchase, no delivery costs will be refunded, immediately and at the latest within 14 days from the day we receive notice of your cancellation of this Agreement. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you can prove that you have returned the goods, whichever is earlier.

 You must return the goods to SICA, Proskauer Str. 4, 10247 Berlin immediately and in any case within fourteen days at the latest from the day on which you notify us of the revocation of this contract. The deadline is met if you dispatch the goods before the expiry of the fourteen-day deadline. 

You bear the direct costs of returning the goods.

They shall only be liable for any loss in value of the goods if such loss in value is due to handling of the goods which is not necessary for checking the nature, properties and functioning of the goods.   End of the revocation instruction, prohibition of assignment and pledge   Claims or rights of the customer against the provider may not be assigned or pledged without his consent, unless the customer has proven a justified interest in the assignment or pledge.   CANCELLATION FORM   Cancellation instructions from SICA upcycling design Right of withdrawal for consumers The following right of revocation exists only for consumers: revocation instruction right of revocation You have the right to revoke this contract within fourteen days without giving reasons.
