At Circles, and the Circles Marketplaceplace respectively, we care about your privacy. That’s why we’d like to inform you that our marketplace uses an open-source analytics tool that protects your data - it’s called Matomo. We do not evaluate your individual data profile nor do we want to advertise certain products or services based on your online behaviour. What we would like to do is fostering simple overall statistics e.g. about user counts, location and language. We also want to check on an anonymous base how marketplace users found our website and how they navigate through the offers at the marketplace. General terms and conditions 1. Accepting this Terms and conditions This document and the other documents that we reference below make up our Terms and conditions (hereinafter, the Terms). The Terms are a legally binding contract between you and Zero Waste Era CK UG (hereinafter, ERA). This contract sets out your rights and responsibilities when you use erazerowaste.com and the other services provided by ERA (the services for the sellers included, see below; hereinafter, the Services), so please read it carefully. A. The other documents. If you use any of our services, you agree to these Terms, to our Privacy policy, and to the specific rules that are relevant for you, depending on how you use ERA’s Services: - if you use the platform to sell your products through our Services, you must read the Seller policy here. - If you use our Services to browse or shop, you can read the Customer policy here. All of these policies are a part of our Terms, so be sure to read the ones that are relevant for you. 2. Privacy Our Privacy Policy details how your information is used when you use ERA’s Services. By using our Services, you're also agreeing that we can process your information in the ways set out in the Privacy Policy, so please read it here. 3. Disputes The EU Commission provides a platform for out-of-court settlement of disputes. This provides information on customers’ rights and gives consumers the opportunity to resolve disputes in connection with their online order without the intervention of a court. The Site provides an online marketplace for the following goods, products, and/or services: groceries and logistics services (the “Marketplace Offerings”). In order to help make the Site a secure environment for the purchase and sale of Marketplace Offerings, all users are required to accept and comply with these Terms of Use. You agree that by accessing the Site and/or the Marketplace Offerings, you have read, understood, and agree to be bound by all of these Terms of Use. If you are a minor, you must have your parent or guardian read and agree to these Terms of Use prior to you using the Site.     INTELLECTUAL PROPERTY RIGHTS   Unless otherwise indicated, the Site and the Marketplace Offerings are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site or the Marketplace Offerings and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Cancellation Policy

1. Platform & services A. Your account on ERA. Browsing certain sections of the website is still possible for those who do not have an account. However, for the full and complete use of the services offered to the CUSTOMERs by ERA’s platform, registration is required. The CUSTOMER is required to register by providing some personal information, indicating a valid personal email address and creating their own personal profile, following the relevant registration procedure explained at the time of registration, to allow ERA to have a sufficient purchase profile to provide the services. The registered CUSTOMERs can access their profile at any time to update or change the data entered. At any time, registered CUSTOMERs can delete their profile by accessing the “My account” section of the website, clicking on "Delete Account". B. Services for registered CUSTOMERs. The service offered by ERA allows registered CUSTOMERs to: - look at the available products that can be purchased through the platform; - select the products that the user intends to order and purchase; - choose between delivery or pickup and between the different ways of receiving the order:   i. Same day: the CUSTOMER must order before 10 am;   ii. Next day;   ii. Schedule delivery; - since ERA works with real local stores that have walk-in customers, sometimes the product you chose online might be out of stock. For this reason the CUSTOMER can previously choose between two options:   i. Find Best Match: by default, the SELLER will do the best to pick a replacement for your item. In      this case, ERA updates, if necessary, the price payable by the CUSTOMER for the different product;   ii. Don’t Replace: If you’d rather not replace, choose this option and get refund of any non-found       items; - pay the amount due for the purchase of the products. C. Monthly subscription / become an ERA member. The CUSTOMER can become a member (hereinafter, the MEMBER) signing up for the ERA monthly subscription service. The MEMBER will pay a monthly which includes: - unlimited free deliveries and pickups; - special product deals /discounts; - deposit of the reusable packaging borrowed free of charge. 2. The order A. Products. ERA only mediates the purchase between the CUSTOMER and sellers and bears no responsibility for the quality of the products. The CUSTOMER can find information about the products and a description of the products on ERA’s platform. The information is only informative and intended to enable the CUSTOMER to assess the products before making a purchase. B. Placement of the purchase order. Placement of the purchase order by ERA entails the immediate charge of the amount of the expense according to the selected payment method. Following the placement of the order, the CUSTOMER will receive an email confirmation of the purchase with express indication of the summary of the ordered products and their prices, the delivery date, and the general and special conditions applicable to the order. C. Products out of stock. Since ERA works with real local stores that have walk-in customers, sometimes the product the CUSTOMER chooses online might be out of stock. In this case, the CUSTOMER can choose between two options: - Find Best Match: by default, the seller will do the best to pick a replacement for the chosen item. - Don’t Replace: if the CUSTOMER would rather not replace, the CUSTOMER can choose this option and get a refund of any non-found items. D. Payment methods. The CUSTOMER can pay the purchase price through one of these payment methods of choice: - cards (Visa, Mastercard, or American Express); - Apple Pay; - SEPA Direct Debit; - giropay. For the payments ERA uses a PCI-compliant service provider. 3. Delivery & pickup ERA will select the 2-hour delivery/pickup slot that creates less CO₂ emissions and will communicate it to the CUSTOMER via email (the order confirmation email). The CUSTOMER can reschedule the time slot in her/his personal profile if it does not fit. The order tracking link which includes the reschedule options are present at your unique CUSTOMER profile. A. Delivery & pickup fees. ERA charges fixed fees per delivery and per pickup, with no minimum order value. Delivery fee is charged per order, regardless of how many shops are chosen in the order. If the CUSTOMER spends over 50€, the CUSTOMER is guaranteed free delivery or pickup. The MEMBER will have unlimited free deliveries and pickups. B. Reusable packaging. The local shop prepares the order in reusable boxes. The CUSTOMER pays a deposit per reusable box or container. Reusable packaging deposit is free of charge for MEMBERs. The CUSTOMER can return reusable packaging on the next delivery or in any affiliated shops. In order to be able to return the reusable packaging it is necessary that the QR code is visible and readable, otherwise ERA or the SELLER cannot accept it. ERA will sterilise and reuse all returned containers and boxes. If they are too damaged for reuse, ERA will make sure to recycle it appropriately. 4. Right of refund/return A. Exclusion. The right of refund/return is excluded for perishable food (e.g., dairy products, fresh fruit and vegetables) or food whose expiration date has been exceeded. The right of refund/return is also excluded for sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. B. Exercise. The CUSTOMER may exercise the right of refund/return in relation to the products other than those listed in the previous paragraph. In cases where the exercise of the right of refund/return is allowed, the CUSTOMER has the right to refund/return for any reason, without any need to provide explanations and without any penalty. To exercise the right of refund/return, the CUSTOMER must send to ERA, within 14 days from the date of delivery of the products, a written communication by email to the following e-mail address info@erazerowaste.com, expressly declaring its intention to refund/return and providing the following additional information: - purchase order number and date of delivery; - the name and address of the CUSTOMER and an indication of an email; - the code of the article or articles for which the right of refund/return is intended to be exercised. In response to the receipt of the communication of exercise of the right of refund/return, ERA will open a practice for the return and will communicate to the CUSTOMER the instructions on how to return products. ERA will refund to the CUSTOMER the full amount of the returned products, within 14 days from the date on which the notice of refund was received, without prejudice to the right of ERA to suspend the payment of the refund until the actual receipt of the products. The refund will be made using the same payment method used by the CUSTOMER. 6. Privacy ERA will process the personal data of the CUSTOMERs in compliance with the privacy legislation as defined in our Privacy policy, available here. Last updated: 25th May, 2021.
